Bona Law is an antitrust boutique focused on antitrust and competition law in the United States and abroad. From offices in San Diego, New York, Dallas, Detroit, and Minneapolis, we help companies around the world solve their competition problems—in courtrooms across the country, before enforcement agencies, at the deal table, and inside their own organizations.
Why an Antitrust Boutique?
Antitrust has become too specialized to approach casually. The doctrines are intricate, the economics matter, and the judgment calls come only from having actually litigated these cases. We built Bona Law on a simple premise: clients should receive the expertise and experience of the largest global law firms, with the personal attention, efficiency, economy, and focus that only a boutique can offer.
Antitrust and competition law is not one of many things we do. It is what we do.
Our People
Our attorneys come from top law schools and judicial clerkships, including federal appellate clerkships. Many bring government enforcement experience from the U.S. Department of Justice Antitrust Division, state attorneys general offices, and the European Commission, and most practiced at leading global law firms before joining us. Several of our partners also held significant in-house antitrust positions—including Chief Antitrust Counsel at AT&T and longtime antitrust counsel at General Motors. That mix of big-firm, government, and in-house experience means we have seen antitrust problems from every angle—including yours.
The firm was founded in 2014 by Jarod M. Bona, who serves as its CEO.
What We Do
• Antitrust Litigation — our core practice: both plaintiff and defense representation involving, for example, monopolization, cartel and price-fixing, group boycotts, and distribution and pricing disputes, in federal and state courts nationwide.
• Antitrust Class Actions & MDL Defense — defending companies in some of the country’s largest antitrust class actions and multi-district litigation.
• Appellate Litigation — antitrust and commercial appeals as appellant, appellee, and amicus, including in the U.S. Supreme Court.
• Mergers & Acquisitions — antitrust counsel for state and federal merger filings and coordination with co-counsel on international merger filings.
• Civil & Criminal Investigations — representing companies and executives before the DOJ, FTC, and other enforcers.
• Counseling & Compliance — practical antitrust advice and compliance programs that fit real businesses.
• State Attorney General Antitrust — both defending state enforcement actions and, in an unusual mark of trust, serving as outside counsel prosecuting claims for a state attorney general.
• Regulatory & Political Advocacy — competition advocacy before regulators and policymakers.
• General Commercial Litigation and industry-specific and international experience spanning technology, healthcare, agriculture and food, automotive, media, and more.
A Record That Reflects Our Focus
Our antitrust litigation results include published appellate victories in the federal courts of appeals: among them a Tenth Circuit decision reversing summary judgment against our client and reinstating its monopolization claims and a Ninth Circuit decision affirming a summary judgment ruling in our client’s favor. We have also secured a settlement with injunctive relief for a software company against a rival that controlled nearly all of its market, won summary judgment dismissing our client from a nationwide price-fixing MDL, defeated class certification in a major electronics-cartel case, and obtained a significant settlement as outside counsel prosecuting antitrust claims for a state attorney general. We are also one of the nation’s leading practices on the state-action immunity doctrine, with amicus appearances in every major U.S. Supreme Court state-action case of the past decade.
Working with Other Law Firms
Law firms with strong client relationships but no dedicated antitrust group regularly bring us in as antitrust co-counsel. Our philosophy: refer the problem, not the client. Because we focus on antitrust and competition, we integrate into your trial team without competing for your client’s other work.
